These Terms of Use (“Terms”) govern your use of Otopia (“the App”). By downloading or using the App, you agree to these Terms.
1. License
The App is licensed to you on a non-exclusive, non-transferable basis under Apple’s Standard Licensed Application End User License Agreement. These Terms supplement that agreement. If they conflict, Apple’s standard agreement controls.
2. Premium, Subscriptions, and Lifetime Purchase
The App provides core features for free and offers additional features through Otopia Premium.
- Monthly and annual plans: These are auto-renewable subscriptions. Unless auto-renewal is turned off at least 24 hours before the end of the current period, the subscription renews and your Apple Account is charged.
- Lifetime purchase: This is a one-time purchase that unlocks Premium features for the purchasing Apple Account. It does not renew.
- Free trial: When offered, the duration and conditions shown on the App Store apply.
- Management and cancellation: Manage subscriptions in iOS Settings > Apple Account > Subscriptions.
- Price and refunds: The price displayed on the App Store applies. Apple processes payments and refund requests under its policies.
3. Your Music Files
Files imported into Sing with a Track must be DRM-free files you are legally permitted to use. Use imported audio only for personal practice and do not infringe copyrights or other third-party rights.
4. Prohibited Conduct
- Illegal use or infringement of third-party rights
- Unauthorized access or interference with the App
- Reverse engineering beyond what applicable law permits
- Fraudulent use of the App or paid features
5. Data
Recordings and practice history are stored on your device. You are responsible for managing and backing up your data. Deleting the App also deletes its local data. See the Privacy Policy for details.
6. Disclaimer and Limitation of Liability
The App is provided “as is.” Pitch, range, and practice results are for reference and do not guarantee complete accuracy or a particular improvement outcome. To the fullest extent permitted by applicable law, the developer is not liable for indirect damages or data loss arising from use of the App. Nothing in these Terms limits rights that cannot legally be limited under consumer protection law.
7. Changes or Discontinuation
Features, supported operating systems, or service availability may be changed or discontinued within reasonable limits. Material changes will be announced in the App or on a public page when reasonably possible.
8. Changes to These Terms
Changes will be posted on this page. Continued use after a material change constitutes acceptance of the updated Terms.
9. Governing Law
Except for mandatory consumer protection rules, these Terms are governed by the laws of Japan.
